1. Agreement

These Terms of Service (“Terms”) govern access to and use of Romb (the “Service”) provided by Romb, Inc. (“we”, “us”, “our”). By using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of the Service

3. Accounts and eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Acceptable use

You agree not to:

  • Use the Service in violation of applicable law or the rights of others.
  • Upload or process content you do not have the right to process.

  • Abuse, probe, scan, or interfere with the integrity or performance of the Service.
  • Use the Service to build a competing product or to train a generalized AI/ML model.

5. Customer content and third-party integrations

Content that your organization connects to Romb through third-party integrations (“Customer Content”) remains yours. You grant us a limited license to host, process, and display Customer Content solely to provide the Service to you. We will not access, use, or share Customer Content for any purpose outside of providing the Service, except as required by law.

Use of third-party integrations is subject to the relevant third party's terms. You are responsible for ensuring you have the necessary rights and permissions to connect those sources.

6. Privacy

Our handling of personal data is described in our Privacy Policy.

7. Fees

Paid plans are billed as described at the time of purchase. Fees are non-refundable except as required by law. We may change pricing with 30 days' prior notice to account administrators.

8. Suspension and termination

We may suspend or terminate access to the Service if you breach these Terms, if required by law, or to protect the security and integrity of the Service. You may terminate at any time by contacting support@romb.ai.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS. IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Changes to the Terms

We may modify these Terms from time to time. Material changes will be communicated via email or a prominent notice in the Service. Continued use after a change constitutes acceptance of the updated Terms.
